www.piccolinagelateria.com.au (the “Site”) is made available by Piccolina Gelateria Trading Pty Ltd (ACN 606 314 229) (“Piccolina”, “we” or “us”). These terms and conditions (the "Terms") apply to any person who accesses the Site for any purpose. By continuing to access the Site, you agree that you enter into a legally binding contract with us upon these Terms and our Privacy Policy.
These Terms, the Privacy Policy, and any additional document or terms we incorporate by reference in these Terms, including, and any other terms published, constitute the complete and exclusive understanding and agreement between you and us. If you do not agree with any term or condition in these Terms, the Privacy Policy, or any policies or additional documents we incorporate by reference, or any subsequent changes, you must not continue to use the Site.
Purpose of the Site
The Site is available to allow you to browse and view details of the products and services offered by Piccolina. On the Site, we may also allow you to interact with us via social media channels, submit online orders through the online ordering service or receive marketing and promotions.
Use of our Site
You’re permitted to use our Site for your own personal and non-commercial use. Piccolina expressly owns the copyright and other intellectual property rights published on our Site. These works are protected by copyright laws and all rights are reserved.
Our Site may not be used, reproduced or stored in any other website or included in any public or private electronic retrieval system or service, without the express written permission of Piccolina.
Online Ordering
If you wish to use our online ordering service, you will be required to create an account and accept these Terms and our Privacy Policy.
Access to this Site and Security
You are solely responsible for how you access our Site, including ensuring that anyone who accesses our Site through your internet connection are also aware of these Terms and that they comply with them.
The transmission of information via the internet is not completely secure and data is submitted at your own risk. Although we take the steps required by law to protect your information, we can’t guarantee the security of your data transmitted to the Site.
Third party links
You may link to the Site as long as you do so in a fair and legal way and that will not cause damage or take advantage of our reputation. You shouldn’t link from a website that isn’t owned by you or that suggests a form of association with or endorsement by us. We have the right to withdraw linking permission at any time and for any reason.
Disclaimer
Piccolina makes best endeavours to ensure that information on our Site is correct. We may make changes to the Site, including products, product details and prices described on it, at any time without notice. To the fullest extent permitted by law, we exclude all liability arising out of your use of our Site or the supply of any products by Piccolina and its associates.
Where applicable, the liability of Piccolina is limited to replacing or refunding payment for goods (in part or full) ordered via our Site in accordance with the Competition and Consumer Act 2010 (Cth).
These Terms shall be governed and construed in accordance with Australian law. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Australian courts.
Promotions
Piccolina gelato for one year prize will be awarded via a Piccolina gift card to the value of $416, which is redeemable for 52 double scoops though the year.
Gift Card Terms and Conditions
By purchasing, accepting, redeeming, attempting to redeem or otherwise using a Piccolina gift card in physical or digital form ("Gift Card") you agree to be bound by these terms and conditions (the "Terms and Conditions"). In these Terms and Conditions, "you" and "your" means the cardholder who has purchased or received a Gift Card. "We" or "our" means Piccolina Gelateria Trading Pty Ltd ACN 606 314 229.
These Terms and Conditions contain the full set of terms and conditions governing your use of a Gift Card. We recommend that you read these Terms and Conditions carefully before using a Gift Card.

Purchasing a Gift Card
Gift cards may be purchased in store or online at https://www.piccolinagelateria.com.au/.
A minimum of $20.00 and a maximum of $250.00 can be deposited on each Gift Card. At our absolute discretion, we may change the minimum and maximum amounts that can be loaded on Gift Cards. If we decide to do this, we will publish details on our website at https://www.piccolinagelateria.com.au/. Any change to the minimum or maximum amounts will not affect your ability to use the available balance already loaded onto your Gift Card as at the date of the change.
All Gift Cards are reloadable. The available balance of a Gift Card at the time of purchase can be increased and added to both in store and online at https://www.piccolinagelateria.com.au/.
Gift Cards that are purchased online will be delivered to the nominated email inbox on the order once payment has been validated and approved.
The issuer of a Gift Card is Piccolina Gelateria Trading Pty Ltd ACN 606 314 229.
Purchases using a Gift Card
A Gift Card may be used for purchases on https://www.piccolinagelateria.com.au/ or at any of our stores.
Invalid or unidentifiable Gift Card numbers will not be redeemed.
No change will be given for any value remaining on a Gift Card. The value remaining on a Gift Card may be used in whole or part against future purchases until the Gift Card expires or the available balance is used in full.
If you want to use a Gift Card to make a purchase that exceeds the available balance on the Gift Card, you must combine the use of the Gift Card with additional payment from another accepted payment method. You agree that we are not responsible if you do not have enough funds on your Gift Card to facilitate a transaction.
A Gift Card may not be used to buy Piccolina Gift Cards.
A Gift Card is not refundable or redeemable for cash or credit, unless required by law.
A Gift Card may be used to make purchases only up to the available balance on the Gift Card. The available balance of the Gift Card is reduced by the amount of each purchase and by other deductions, if any, that may be required by law.
Expiry and value of a Gift Card
Your Gift Card will be valid for use for three (3) years from the date of issue. Upon expiry, you will forfeit any balance not used prior to the expiry date.
You can confirm the balance of a Gift Card in the following ways:
on our website at https://shop.piccolinagelateria.com.au/s/gift-cards;
by scanning the Gift Card’s QR code;
by accessing your digital gift card in your Apple Wallet; or
by presenting the Gift Card at the counter of any of our stores.
We reserve the right to correct a Gift Card balance if we believe on a reasonable basis that a clerical, billing or accounting error has occurred.
Lost, stolen or damaged Gift Cards
Protect your Gift Card like cash. Lost or stolen Gift Cards will not be replaced or refunded. The bearer of a Gift Card will be taken to be the owner of that Gift Card.
You agree that we may deactivate, cancel or suspend any Gift Card if we suspect fraud, unlawful activity or (what we consider to be, acting reasonably) improper Gift Card use. You agree that you will not use a revoked Gift Card.
General Terms
The purchase and use of Gift Cards are also subject to the Square AU Pty Ltd ACN 167 106 176 (“Square”) “Give and Get Local Directory Terms of Service” found on the Square website at https://squareup.com/au/en/legal/general/giftcard?country_redirection=true (“Square Terms and Conditions”).
These Terms and Conditions are intended to be read in conjunction with the Square Terms and Conditions.
Resale of Gift Cards is strictly prohibited. Gift Cards that are resold may be considered invalid and we are not obliged to allow the recipients of those Gift Cards to use or redeem the Gift Card.
A Gift Card is not a credit, debit, or charge card. No fees apply.
We reserve the right to change the terms of the Gift Card program or amend these Terms and Conditions at any time and to contract with a third party to administer the Gift Card program. We may amend these Terms and Conditions at any time by posting the amended terms and conditions on our website at https://www.piccolinagelateria.com.au/. Except as stated elsewhere, all amended terms will automatically be effective 30 days after they are initially posted. Any change to the terms of the Gift Card program or these Terms and Conditions will not affect your ability to use the available balance already loaded onto your Gift Card as at the date of the change.
We may assign these Terms and Conditions at any time to another entity. However, if we assign the Terms and Conditions, the Terms and Conditions will remain substantially the same unless you are notified.
Disclaimer of Warranties; Limitation of Liability
To the extent permitted by applicable law including the Australian Consumer Law, we and our respective affiliates make no representations, warranties or conditions of any kind, express or implied, with respect to a Gift Card or any purchases made with a Gift Card. For the avoidance of doubt, nothing in these Terms and Conditions excludes or is intended to exclude any rights and obligations you or we may have under the Australian Consumer Law.
